What these terms cover

These terms apply to your use of gaffargpssolutions.com. They do not replace or vary your service agreement with us. If you are a customer, the terms of your tracking, monitoring and recovery service are set out in the agreement you entered into at the point of sale and installation. Where the two differ in respect of the service, that agreement governs.

By using this website you accept these terms. If you do not accept them, please do not use the site.

Information on this site

We publish information about our products, pricing and service in good faith and keep it current. Even so, specifications, prices and availability can change, and pages may not reflect the latest position at the moment you read them.

Nothing on this website is a binding offer or a quotation. A quotation is what we give you directly, in writing or on a recorded call, for your specific vehicle and circumstances.

Articles on our blog are general guidance about vehicle security in Trinidad and Tobago. They are not legal, insurance or security advice for your particular situation.

Statements about our record

Where we publish figures about our performance — recovery rate, recovery times, vehicles protected — they describe our actual record over the stated period. They are a statement of what has happened, not a guarantee of any future outcome. No vehicle security system, ours included, can promise that a theft will never occur or that every vehicle will always be recovered.

Using this site

You agree not to:

• Use the site for any unlawful purpose
• Attempt to gain unauthorised access to any part of the site, our systems, or any customer account
• Interfere with the operation of the site, or introduce malicious code
• Copy, scrape or republish substantial parts of the site for commercial use without our written permission

Intellectual property

The content of this website — text, images, video, design and the Gaffar GPS Solutions name and logo — belongs to us or is used with permission. You may read, share and link to our pages. You may not reproduce them commercially or present our material as your own.

Links to other sites

Where we link to another website, we do so because we think it is useful. We do not control those sites and are not responsible for their content or their privacy practices.

Availability

We aim to keep this website available, but we do not guarantee uninterrupted access. We may change, suspend or withdraw any part of it. Website downtime does not affect your tracking service, which runs independently of this site.

Liability

To the extent permitted by law, we are not liable for loss arising from your use of, or inability to use, this website, or from reliance on general information published here. This does not limit any liability that cannot lawfully be excluded, and it does not affect your rights under your service agreement.

Terms that apply to our services

The following apply to our tracking, monitoring and recovery services. Where your signed service agreement addresses the same point, that agreement takes precedence.

Your responsibilities

• Give us accurate information about you and your vehicle, and tell us when it changes — an out-of-date contact number is the most common reason we cannot reach someone during an incident
• Keep your account credentials confidential
• Use the service lawfully, and not to harass, stalk or harm any person
• Do not tamper with, remove or attempt to disable installed equipment

Payment and billing

Our services require payment of installation and subscription fees as quoted to you. Fees are non-refundable unless stated otherwise or required by law. We may change pricing on notice, and you are responsible for any applicable taxes. Where a subscription lapses, monitoring and recovery services may be suspended until payment is brought up to date.

Equipment

Installed equipment must be maintained in working order and must not be interfered with. Where equipment is removed, damaged or disabled, we cannot be responsible for a failure to track or recover the vehicle.

Termination

Either of us may end the service in accordance with your service agreement. We may suspend or terminate service where fees remain unpaid, where the service is being used unlawfully, or where equipment has been tampered with. Ending the service does not affect amounts already due.

Indemnity

You agree to indemnify us against claims arising from your unlawful use of the service, or from your use of it in breach of these terms or your service agreement.

Governing law

These terms are governed by the laws of the Republic of Trinidad and Tobago, and the courts of Trinidad and Tobago have jurisdiction over any dispute arising from them.

Changes

We may update these terms. The date at the top of this page shows when they last changed.
